WHAT IS AN ESTATE PLAN, AND WHO NEEDS IT?

The short answer is EVERYONE needs an estate plan. But, you don't have an "Estate", you say? Yes you do! Everyone, even those people with little or no assets has an "Estate". An estate plan directs how your belongings are distributed upon your death. Without an estate plan, your possessions are distributed according to state law, and that may mean that family may inherit your assets even if you do not want them to. The solution? An estate plan. This can include a will and/or a trust, which will direct a person of your choosing to divide and distribute your belongings in almost any way you wish. Depending on the size of your estate, this could be a relatively low cost task, and gives you the peace of mind, knowing that your possessions will be given to the correct people upon your passing.

 

WHAT IF I WANT TO CHALLENGE SOMEONE'S WILL/ESTATE PLAN?

This is called Probate. If you feel that you have been wrongfully excluded from a will, trust or estate of another, you can challenge that in court. Likewise, anyone can challenge your estate after your passing. A solid estate plan can prevent problems, family feuds, and long litigation.

 

DID YOU KNOW?

There are certain state laws that require a will to be filed, or a probate case to be opened, within a certain period of time after the passing of a family member or friend. If these laws are not followed, it opens up the door for others to challenge the estate, and may hold an executor/executrix or administrator liable.
